Terms of Service

1. Acceptance of Terms

By accessing or using the Talent Dynamix platform (“we”, “us”, “our”), you agree to these Terms of Service, our Privacy Policy, and any additional guidelines provided within the platform. If you do not agree, you may not use our services.

2. Nature of the Platform

Talent Dynamix is a marketplace connecting businesses (“Clients”) with independent professionals (“Freelancers/Talent”) for project-based, contractual, or permanent work opportunities.

Talent Dynamix is not an employer of freelancers and does not guarantee any specific outcomes, earnings, or contracts.

3. Account Registration

• Users must provide accurate, current, and complete information.

• You are responsible for safeguarding your login credentials.

• Accounts cannot be shared, transferred, or used for fraudulent activities.

• Users must be 18 years or older to register.

4. Posting Projects & Applying for Work

• Clients must post clear and accurate project descriptions.

• Freelancers must only submit truthful proposals and may not misrepresent skills or qualifications.

• Spam, misleading postings, or fraudulent activity may result in account suspension or termination.

5. Payments

• All payments between Clients and Freelancers must be processed via the Talent Dynamix platform unless otherwise agreed in writing.

• Clients pre-fund project milestones (escrow). Funds are released to freelancers upon project or milestone approval.

• Talent Dynamix charges a service fee on transactions (details available in your account dashboard).

6. Dispute Resolution

• Clients and Freelancers are encouraged to resolve disputes directly via the platform’s messaging and milestone review process.

• If disputes cannot be resolved, Talent Dynamix may review the case but does not guarantee a specific resolution.

• Talent Dynamix reserves the right to mediate, refund, or release funds based on evidence provided.

7. Prohibited Activities

Users may not:

• Use the platform for illegal, fraudulent, or harmful purposes.

• Circumvent the platform to avoid service fees.

• Share another user’s confidential information without consent.

• Post, upload, or transmit offensive or unlawful content.

Violations may result in suspension or permanent account removal.

8. Intellectual Property

• Content uploaded by Freelancers (portfolios, deliverables) remains their property until transferred to Clients per project agreements.

• Clients receive rights to work upon full payment, unless otherwise stated.

• Talent Dynamix branding, code, and proprietary materials remain our property.

9. Limitation of Liability

Talent Dynamix is not liable for:

• Disputes between Clients and Freelancers, including non-performance or misrepresentation.

• Loss of data, profits, or opportunities due to technical or operational issues.

• Any indirect, consequential, or incidental damages related to use of the platform.

10. Termination

Talent Dynamix may suspend or terminate your account if you:

• Violate these Terms,

• Engage in fraudulent or unlawful activity,

• Harm the reputation or functionality of the platform.

11. Changes to Terms

We may update these Terms periodically. Continued use of the platform constitutes acceptance of any changes.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved under South African jurisdiction.
